Chesterfield Circuit Judge T.J. Hauler sentenced Osborn to 10 years in prison with eight of those years suspended. Wednesday, Hauler decided to stay the execution of the two-years he was supposed to serve because the guidelines did not call for incarceration. Prosecutors made a deal with Osborn that they would not pursue a forcible sodomy indictment if he pleaded guilty to having carnal knowledge of the girl. According to Osborn's attorney, the victim consented to be tied up and raped but prosecutor Erin Barr argued that because of her age she could not legally consent.
