New York - Judge Temporarily Halts Army Base 'Pizza Delivery Guy' Deportation

What started as a routine background check during a pizza delivery at an Army base turned into the arrest of the pizza delivery driver when military police discovered there was an ICE warrant for his arrest. The delivery driver, Pablo Villavicencio Calderon of Ecuador, was delivering pizza to U.S. Army Garrison Fort Hamilton when military officers performed a background check and discovered the warrant. Villavicencio was immediately detained and transferred to the Federal Immigration Enforcement Authority's custody.

Now, Democrat judge Alison Nathan who was appointed by Obama is trying to halt the deportation of the delivery driver at least until a July 20th hearing. Judge Alison J. Nathan of the U.S. District Court for the Southern District of New York ordered the government to show why a temporary preliminary injunction should not be granted in the case of Pablo Villavicencio Calderon. The 35-year-old delivery driver was arrested on June 1 and has been held by Immigration and Customs Enforcement in New Jersey.

Gregory Copeland of the Legal Aid Society's Immigration Law Unit said, "Although we are disappointed that Pablo will remain detained, today's stay is a victory for him and his family, and also for due process and the fair administration of justice. When Fort Hamilton's public affairs office said security officers found Villavicencio had an ICE warrant for his arrest they contacted the federal agency. ICE says Villavicencio was ordered to leave the country in 2010 but he violated that court order and remained, illegally, inside the country.

Liberals love to twist the truth whenever an illegal immigrant is involved and plenty of prominent Democrats have spoken out about Villavicencio's arrest including New York's governor Andrew Cuomo. "There's compelling evidence that Pablo Villavicencio was improperly detained," Cuomo tweeted Saturday. "He should be immediately released from ICE custody and an investigation should be launched into the circumstances of his arrest." How did Cuomo make it into the office of governor without understanding how a federal warrant works?
