A man in Tampa, Florida has been arrested for the murder of his 7-year-old stepson after he beat him to death for sneaking out of bed at night.
The arrest report reveals the victim's siblings told police they saw their stepfather pick Brice up by the leg and throw him against a shelf along the wall. They also told detectives they saw blood coming from his nose and mouth and he never woke up.
Detectives determined through their investigation that Montgomery had punched the small boy in the face, mouth, and stomach with a closed fist. The stepfather also threw the victim around the hotel room and shoved his face into the carpet.
Montgomery admitted to detectives he picked up his stepson Brice and threw him onto the bed after catching him trying to sneak out of bed to get a cookie.
The arrest affidavit also reveals Montgomery said Brice hit his head on the headboard when he threw him onto the bed but insists he was "fine" after that.
Brice's death has been ruled by the Medical Examiner's Office to be the result of homicidal violence.
